Texas CPS frustrated that Barbara Jessop won’t say her daughter was “married”

by Kurt Schulzke on January 7, 2009

Those masters of irony at Texas CPS are at it again.  Flying in the face of Texas statutes that make bigamy and underage “marriage” legally impossible, they’re threatening to take permanent custody of 14-year-old Merrianne Jessop because, in part, her mother refuses to say that Merrianne was married at age 12 to Warren Jeffs.  Meanwhile, hundreds if not thousands of Texas children legitimately at risk of abuse go entirely unnoticed.  It’s almost painfully delicious.

I cannt evaluate evidence untilI know what that evidence is. Your vagueness leads me to believe that evidence does not exist. When Barbara’s lawyer’s demanded a jury trial, CPS suddenly decided she was making progress.

SKK January 14, 2009 at 3:48 pm

correct .. you do not know what the evidence is but your arguments assume otherwise. before you decide cps is all wrong andbarbara is all right why dont you wait and see what the evidence is?

if it makes you feel any better, even if theres evidence supporting termination cps will likely screw up the case anyway and merrianne will be returned to a harmful environment.

SKK January 14, 2009 at 3:55 pm

also youre mistaken about cps changing course when a jury trial was requested. it’s assumed that termination cases will be tried by jury and i dont know why anyone would think a west texas jury would be favorable tobarbara. plus, cps has not changedits position.

That 15 year old in Dallas is not married. Her 20 year old boyfriend lives at the house with her mother and her. In the initial report, the coverage was apparently a lot more glowing, and several readers pointed out that this is a felony under Texas law and turned the family in. I doubt the police or CPS care even a little, because this 20 year old is not living with a 15 year old and fathering a child on her for religious reasons.

I find it incredibly disassociated from reality that anybody could look at that video of CPS yanking Merrianne from her family and blame Barbara for it. CPS released that girl’s photograph kissing Jeffs, unredacted, did not seal the records, thus subjecting her to the first glare of publicity, and told the world she was sexually abused- accompanied by photographs of her face and her name.
That video of CPS coldly, without the slightest sympathy, taking her from her family against her will is not shameful to Merrianne, it’s shameful to CPS.

There is nothing in this record which indicates the marriage was consummated .

Brooke Adams, who until recently said the FLDS say the marriage was unconsummated, recently lost the allegedly, and says it is unconsummated. I trust her a lot more than I trust you.

CPS claims 12 cases of under-aged marriage, but only 10 indictments are about sexual abuse- indicating that they know at least two of those marriages were sealings, in name only.

And, in fact, concerning another underaged marriage that took place that same night:
The CASA report and accompanying exhibits do not explicitly say that any sexual activity occurred. Indeed, FLDS members say consummating a marriage may not take place right after a wedding ceremony in their culture.

These are the indictments against Warren Jeffs:
Warren S. Jeffs, 53, aggravated sexual assault; sexual assault of a minor; bigamy.
There is nothing here, contrary to your claim, that proves that Merrianne is the victim CPS is alleging-
According to the records submitted in court, he was also sealed to Brenda Lei Fischer when she was 12 (I am not sure CPS did the math right, in one official record they claim Merriane was 11, in another 12, and I’ve also heard that there’s a 14 year old bride, Loretta)- Out of three under-aged marriages, he’s only charged with sexual abuse for two. I’ve had more than one social worker say the kiss alone is legally sexual abuse. If that’s true (and, as I have said before, I don’t like that picture or the act it depicts- that kind of kiss between an adult man and a 12 year old is deeply disturbing)- but it’s not a consummated marriage, and if the social workers are right that the kiss alone is legally sexually abuse, than I think, SKK, that all the indictments prove, at best, is that Warren Jeffs kissed one girl (sexual assault), possibly consummated another under-aged marriage (the aggravated sexual assault charge), and they know perfectly well they don’t have any evidence to support charges on the third under-aged marriage.

Thomas Forguson January 14, 2009 at 6:17 pm

It depends on who you would rather believe. The FLDS has consistantly told the truth and CPS has consistantly lied. Remember the CPS said 31 of 53 Girls had been or were pregnant. Turns out that 26 of the 31 were adults. CPS ignored such evidence such as birth cirtificates and relied on visual inspections. Who should I believe?
You said the best predictor of future behavior is analstysis based on past behavior. The FLdS generally take longer than a month to consumate a relatinship. Who should I believe?
Take the case of Tersa Steed.CPS claimed that she was married at 14. However, she did not become pregnant until she was 16.This puzzled CPS who ordered a DNA test. CPS has chosen to believe liars like Carolyn Jessop and developed no insights into the FLDS. Who should I believe?
When I see that video I see a loving family being forced to hamd a family member to a bunch of heartless CPS goons who express no compassion for Merrainne. Who should I believe?

SKK January 14, 2009 at 8:28 pm

The FLDS generally take a month to consummate a relationship? Says who?

Speaking of Teresa Steed, I wonder what’s going on with that case. I do believe there is evidence that she was married at 14, but I don’t believe the pregnancy at age 16 is why the DNA was ordered.

So where do you develop your insights into the FLDS? And what exactly has Carolyn lied about that CPS wrongly believes? That is a tired, worn out non-argument. Carolyn has nothing to do with this.

You believe whoever you want to believe. The evidence is what it is and your strong belief or desire won’t change it.

R January 14, 2009 at 8:35 pm

Well, Carolyn did repeat the broken bones lie – originated by CPS, but she was repeating that even after they backed down from that particular bit of hokum.

And correct me if I’m wrong, but IIRC she offered testimony re Barbara in MJ’s custody hearings.

Joey January 14, 2009 at 8:56 pm

SKK, if there was evidence Merrianne had been sexually assaulted, it would have come out at the custody hearing. But it didn’t.

These are loving, innocent families, who are a tad behind the times; but want to obey the law. Stealing their kids is inhumane . . . [redacted].

Thomas is telling the truth. Every word on the TRUTH WILL PREVAIL site has proved true, and will continue to do so until truth has conquered all the anti-FLDS lies. Lies have speed, but truth has endurance. Truth cannot be destroyed, but remains eternally diamond truth. The lies will all fade away in time, and those who have perpetuated them will live in shame. All these lies only point out the fact that the FLDS are the true religion of God. You can read their history from the days of the Prophet Joseph till today, and follow by their persecutions who is the leader of the true church. The devil always strikes at the head.

Christ says those who live Godly in Christ Jesus shall suffer persecution. It’s as old as history, as written in the Bible, which is the first history of this earth that we know of.

TRUTH WILL PREVAIL!!!

OH, AMERICA

Land of the free, home of the brave! Land of the pilgrim’s pride. Land where our fathers died! Arouse thyself; awaken, and do not delay. Let thine resolute voice now be heard from sea to sea! Thou, into whose hands the Almighty has thrust the scepter of liberty! Thou, upon whose breast the God of all justice has caused the principles of liberty and true justice to nurse and grow. Thou, into whose hands has been placed the commission, to route the oppressor where ere he might lurk in every nation. Thou, whose patriots, are still at this moment, spilling their blood to safeguard the religious rights of all men. OH, AMERICA, thou defender of the defenseless. Thou lover of the purity of motherhood, and the sacredness of the newborn child. Thou champion of champions! AMERICA, the victor of Bunker Hill; of the Argonne; of Okinawa, Iwo Jima and Corregidor; of the storm-troopers of Hitler and Stalin; that stood so recently victorious upon “Old Baldy” and “Pork Chop hill” in the far recesses of POLYGAMIST KOREA. Thou, the noble and unvanquished defender of innocence, come from thine hiding place and let thy will be known; for thy mothers, the kind and tender ones, those of “EXCELLENT CHARACTER” are now prostrated against the wailing wall, away from their kindred and in the houses of their enemies! Thy children, the babes of innocence, have been tracked down as beasts of prey! Thy children, into whose hands thou expectest to thrust the gun and bayonet, that in the strength of their youth, they might defend thine shores and the religious liberties of all men! These, thine little ones, are restless and fretful, and in the quiet darkened hours of the night can be heard to sob for their fathers who are far away. Thy sons, OH AMERICA! Thy strong sons; those who have borne the heat of the summer and the cold of the winter. From whose bosom you have conscripted the flower of their young manhood to bear the STARS and STRIPES abroad. Thy sons, from whose worn hands thou hast willingly taken taxes and support! All this they have done without a grudge, and with the firm faith that they were a part of the “CRUSADE FOR FREEDOM” that is moving upon the minds of all men. These, thy sons, are now alone in their empty houses, while their families, they know not where, are scattered and smitten. Come, oh, America, and linger not; for these strong ones have now been leashed to the torture racks, for conscience sake.

Ere it is too late, let freedom ring, “that this nation, under God, might have a new birth of freedom; that this government of the people, by the people, and for the people, shall not perish from the earth.”

It is the marriage system of the Saints against which the cry is now raised, though it has not always been so, for they were persecuted as bitterly before such a practice existed among them as they have been since. The Saints believe in marrying more wives than one, and in maintaining them and their children. Is this contrary to the laws of nature? We answer, no! For wherever a man is found in his natural state he is a pluralist. From this practice no evil can result; it promotes life and does not destroy it. No loathsome disease follows legitimate marriage. The world confounds promiscuity and plural marriage, and speak of them as being the same: but not so! Promiscuity, being opposed to natural laws, curtails offspring, brings diseases of the most loathsome kind; blights, destroys, and drags down to an untimely death its votaries. Visit the anatomical museums, and see there evidences of the fulfillment of God’s words: “I the Lord thy God am a jealous God, visiting the iniquity of the fathers upon the children unto the third and fourth generation of them that hate me.” Upon every hand we can see the frightful effects of man’s perverse course in breaking nature’s laws. From legitimate marriage, whether to one or more wives, none of the frightful evils resulting from promiscuity have ever been manifested in any degree. Blessings have followed marriage, cursings promiscuity. Deity has written upon plural marriage, honor, power and glory, in the coming forth of His Son Jesus through the lineage of David.

Me January 14, 2009 at 11:13 pm

We submit these facts, knowing full well that the Saints cannot be condemned by an unprejudiced mind for disregarding natural law, breaking the laws of their country, or treating with contempt the divine law. Those who have assailed the Saints have violated their oath of office, and have aimed a blow at the bond of union that should exist in the nation by recommending unconstitutional laws. They must in time suffer for the wrongs they have done an innocent people, and we can afford to wait for time to vindicate our innocence and avenge our injuries.

Thomas Forguson January 15, 2009 at 8:02 am

SKK: you must learn to think. I have followed the news about the FLDS. It is entirely possible for Teresa Steed to be married at age 14 and then wait until age 16 to consumate her relationship. If the DNA test confirms that the baby belongs to Teresa Steed, will you listen to me? Listen to wnat the evidence is telling you. Corrrect analysis willgive you the truth about Merrianne Jessop.

SKK January 15, 2009 at 9:52 am

thomas – there is no question teresa steed had a baby at age 16. they are not testing the baby’s dna to determine whether teresa gave birth. i have no idea when she consummated her marriage other than to say the deed was done at th latest 9 months before the baby was born. prior to that – absence of baby does not equate to abstinence. the fact of the matter is she and nathan did not wait until she was of legal age. i have no idea why you say flds wait a month to consummate a marriage. enlighten me?

by the way, if the dna test confirms that the baby is not teresa steed’s will you listen to me?

Me January 15, 2009 at 12:19 pm

SKK,

If you read my posts, my question to you is, “why do you and Texas want to stop somebody in their religious beliefs? and where is the victim in all this? who is asking the state for help?

Obviously all these women at YFZ are happy in their beliefs. Isn’t that what America is all about?

You want to say that marriage is abuse. Thomas is trying to tell you it plain and simply IS NOT.

These laws about who can decide what at what age are nonsense! You know as well as I do that age has nothing to do with maturity. There are twelve year old’s among the FLDS that know more about raising children than all the CPS workers put together, and are fully capable of raising them.

Thomas Forguson January 15, 2009 at 1:55 pm

SKK: take a course on reading comprehemsion. I said MORE than a month. Waren Jeffs had only a month to abuse Merrianne. There are reasons why this abuse didnt happen. Due to the arranged nature of their marriages, the FLDS take time to know one another before consumating their marriages. You said you judge people by their past actions. the customs of the FLDS did not give Warren Jeffs enough time to abuse Merrianne Jessop. It is very plausable for Teresa Steed to be married 1t 14 and anor become pregnant until she was 16.These people do not practice birth control. If she did not become pregnant until she was 16, it is because she did not have sex until she was 16. A favorable result for your position would make it difficult to maintain my position. However, Remember Terersa Steed was willing to go jail in order not to reveal the location of her baby. You must learn the customs of the FLDS before you judge them. Youa re judging them according to the customs of your society.

Thomas Forguson January 15, 2009 at 3:38 pm

SKK: To clarify a positive result for your position would make it difficult for me to maintain mine. Remmebr that Teresa Steed was willing to go to jail to keep from revealing the location of the baby. The beby is hers.

Joey January 15, 2009 at 7:03 pm

by the way, if the dna test confirms that the baby is not teresa steed’s will you listen to me?

Oh Christ, does SKK believe the baby is Merrianne’s? I thought Brooke has already found out and reported that M. is a virgin.

Joey January 15, 2009 at 7:11 pm

This won’t be the first time SKK’s [redacted] imagination regarding hidden babies has run away with her. Remember Teresa Jeffs?

The scary thing is considering what these girls had to go through to prove their innocence to these CPS skeptics. Imagine if what has happened to these poor girls from YFZ in state custody, happened to your neighbor’s girls or your own. Visualize that. Put you and yours in their place; girls you know forced to undergo virginity tests and secret interrogations, and then tell me this isn’t all born of cultural prejudice.

SKK January 16, 2009 at 1:07 am

We’ll see what happens ;)

moore March 7, 2009 at 4:18 pm

Joey- it is evident you are an FDLS member. Enjoying the privileges of the male-dominated sect life and promoting their values is a hard burdern to bear.
