Teresa Jeffs’ CASA times strike, releases documents for maximum weekend effect
The Houston Chronicle reports that Teresa Jeffs’ Court Appointed Special Advocate (CASA) has delivered “pictures, diaries, and a marriage record” that purport to show that
Warren Jeffs married his underage daughter to the 34-year-old son of his chief deputy, one day after she turned 15 . . .
“Based on the information in the attachments, CASA feels that (the girl) would be at risk for continued sexual abuse,” the CASA report states.
Every time the State of Texas produces a document like this, my response is the same: until it is authenticated and cross-examined, it should mean nothing to fair-minded people. The release, timed to generate maximum uneducated speculation and rumor over the weekend, is unprofessional if not unethical on the part of the CASA. But that’s exactly the behavior that we’ve come to expect from Texas CPS, Judge Walther and their groupies.
Even if these materials are at some point authenticated, they will be meaningful only as to the individuals to whom they directly relate. They have nothing whatever to do with other members of the FLDS church unless and until such a connection is proved through adversarial examination.

Or, you could look at it as evidence of the truth, that the FLDS lies.
Blues, two things. One, if they have not slept with one another, no one has a right to care.
Two, you have ZERO credibility. The facts have rarely if ever been on your side or that of Texas throughout his Fiasco. The safe thing to do is ALWAYS believe the FLDS and their members, because to date, nothing they have told us has been shown to be false. On the other hand, Texas has backed so many frauds that they can only be right by MISTAKE.
Actually the facts have always been on Texas side. 40k of Environmental fines in 3 years for starters on your law abiding FLDS in Eldorado leads to distrust. Thanks very much to Randy Mankin and his pilot friend for the photos that documented the evidence. No one would know what they were doing without the Eldorado Success. Second: Willie Jessop is a mouth only and has no power to do anything. Only 8 people have registered to vote in Eldorado. You know why? It would prove they live in Texas and the laws of our state would apply to the TEXAS FLDS. Furthermore, registration requirements are different in local county elections than national elections so they blew that too! You are too eager to believe people that never fly the American flag, have a unique hatred for any world that they did not create and have a theological quirk that follows a man that is a devout racist, bigot, and sex offender (listen to his lectures on blacks) and believe “lying for god” is perfectly alright. Grand Jury meets next week. Wonder where Merrill Jessop or Wendell Neilson are? You go BluesMan!
Hugh, don’t believe me, ask Shurtleff.
“I’ve got a word for Willie Jessop, that lives in Utah, and is defending this, and says that it isn’t going on. He’s a liar.”
He said that at 5 PM on May 30th on TV.
Of course, since you haven’t been correct on your interpretation of the law yet, I don’t expect you’re any better in interpreting the news or the mood of Texans.
Your readers need to do a little homework on brother Willie. He was the FDS enforcer, strongman and Warren Jeffs personal body guard. Basically is the leader of the FldS –SS squad and his Hitler is Warren Jeffs. Don’t take my word for it. Check it out! Many of the FLDS are on the Texas Polygamy Blog. Go back in the archives for a couple of years and you will see “good ole Willie” keeping people from funerals or kicking them out of their houses. Now isn’t he sweet? Bet you think O.J. was innocent too…
Blues, you keep talking like you’ve PROVED something. In the end it is not going to be your confident presentation that proves anything, it will be the facts, and I’m comfortable with the facts. Teresa Jeffs is a virgin. I believe that. That fits perfectly with the fact, (if it is a fact) that she is “spiritually married” to a much older man. Texas can have no interest in the religious fantasies of the FLDS. That is in fact what they would be from Texas perspective, religious fantasies. From the FLDS perspective they are real enough. Until someone rubs uglies though, there isn’t anything to talk about.
In addition, you may end up having a sexual relationship proved between Teresa and this older man and I would be proved wrong. I rather doubt it, but it’s hypothetically possible. I find it terribly disturbing that Texas raided the FLDS ranch, saw nothing worthy of further investigation and then they turned out everyone’s closet, safe, sock drawer and grabbed little girls diaries in the hopes of finding SOMETHING salacious. Well GOODY for you if you actually do. You’ve VIOLATE the rights of every one of them. Texas had no business in a 15 year old girls diary. They’re a bunch of creepy old perverts living vicariously and thrilled by the idea of a young girl having sex. If they prove that Teresa did have sex they can now all leer at her as she walks by knowing that she’s gotten naked and done the horizontal mambo.
Never mind that we had to have cause to look, we didn’t have cause to look and yet we went looking up the skirt of a 15 year old. That’s SICK. It WASN’T our BUSINESS. You HAD no right.
Having said that I don’t think you will be able to prove she had sex with anyone.
It is possible that Teresa’s CASA guardian and her wonderful attorney ad litem have laid the groundwork to have Teresa cut free from Judge Walther’s Court and from CPS. Let us assume that everything, well, almost everything in the CASA report, as reported by the Houston Chronicle and the Deseret News, are factually correct. Particularly that part about Warren Jeffs having married Teresa, at age 15, to an adult man. Bear with me while I quote some Texas Family Code material of which the CASA guardian and the attorney ad item might not have been aware.
All references are to the Texas Family Code as set out in O’Connor’s Family Code 2006–2007.
Sec. 1.101: “….every marriage entered into in this state is presumed to be valid unless….” it is void or voidable as set out in Chapter 6.
Sec. 1.104: “Except as expressly provided by statute or by the constitution, a person, regardless of age, who has been married in accordance with the law of this state has the capacity and power of an adult, including the capacityy to contract.”
Sec. 2.202(a): “The following persons are authorized to conduct a marriage ceremony…a person who is an officer of a religious organization and who is authorized by the organization to conduct a marriage ceremony….”
See Husband v. Pierce, 800 S.W.2d 661, 664 (Tex.App.–Tyler 1990, orig. proceeding). “[E}ven in the absence of a valid marriage license authorizing a marriage ceremony, whether conducted by a person authorized by (sec. 2.202) or not, is nevertheless valid ‘if there was a reasonable appearance of authority by that person, and at least one party to the marriage participated in the ceremony in good faith and that party treats the marriage as valid.’ ”
Sec. 101.003: “‘Child’ or ‘minor’ means a person under 18 years of age who is not and has not been married or who has not had the disabilities of minority removed for general purposes.”
What this all means to me is that if CASA guardian and Malonis are factually correct then Teresa is outta there. The authority of the Court and CPS to exercise control such as that being exercised over Teresa is limited to children. By the plain language of the statute, assuming CASA guardian and Malonis and the Court don’t destroy the report they filed Friday, is that the Court has no right to exercise jurisdiction over Teresa because she is not a child. She is an adult.
What sets me off on a course of uncontrollable guffaws is the fix that the guardian ad litem and attorney ad litem have themselves in. Wow. What the hell were they thinking.
Teresa needs to have her own attorney go into Court Monday morning and file a motion to dismiss for lack of jurisdiction, citing and referring to and attaching as an exhibit the guardian’s report. Teresa doesn’t have to do anything else. She can continue to deny, outside of court or in the court, that she was ever married. If the Judge finds she was, she gets cut loose. If the Judge finds she was not, then we can all have a good belly laugh at this latest F.U. by her appointed guardian and attorney.
tx, you said “Or, you could look at it as evidence of the truth, that the FLDS lies.”
Tell us, was Teresa lying when she wrote that material in her diary (the one you creepy old dirty minded men are having such fun with), or is she lying now?
Also, I’m sure you realize that all Teresa and her mother have to do to get this big pile of bigoted cow flop taken care of is drive to South Texas and get Teresa married. To anyone or to the guy identified in the news reports. It don’t matter. She will then be an adult and can give you and yours the big middle finger.
Of course, she and her mon will have to dress a bit differently.
FWIW, I have never seen any reports / articles quoting Teresa denying she was married, nor admitting it.
She has not lied about being married and I challenge any that claim such to provide proof.
Doran,
The problem with the law as you cite it is the court it would have to be presented in.
It has already been reported this will be a “private hearing”. Who among us doubts that walthers will do what ever she pleases, involving only the parties she would be pleased to meet with?
Lets recall that as she was addressing Ms Balovich of the TRLA, the “sepcial exceptions” filed and all other filings attorneys brought up, she pointed out to all at the on April 17th;
“You have not waived all of your rights… The law requires that I hold this hearing within fourteen days of the removal of the children. You still have the final hearings… “
Some are still searching to determine which of their rights had been waived by entering that creature’s courtroom!
What did Teresa say…
“…I am so sick of being called that when I am absolutely not a victim of sexual abuse and you have no evidence to prove that I have ever had sexual relations,” in her e-mail to Malonis.
Hope the GAL read that.
It is my understanding that Judge Walther was going to speak with Teresa in chambers, perhaps to guage Teresa’s sophistication, perhaps to browbeat her. Who knows for sure. But whatever the Judge does there, if Teresa gets another attorney to file the motion to dismiss, that motion will have to be heard in open court. GAL and AAL have put themselves into checkmate. If the court finds from the evidence submitted that Teresa is married, then she is an adult and is no longer amenable to Malonis’, CPS’ and Judge Walther’s kind attention. If the court finds there was no marriage, then Teresa’s honesty is established, as well perhaps as her ability to make a decision about her attorney, while GAL and AAL are revealed to be somewhat incompetent buffoons.
What hearing on Monday?
Of the several points I keep making about Teresa Jeffs, one is that she can indeed be “spiritually married” and a virgin. Texas needs to prove that she had sex with an older man, outside the bonds of marriage, and that it happened in Texas. Personally, I think Teresa is a virgin. We’ll see.
There will still be a long row to hoe if she is not. I also believe when it is all said and done that Texas be proved to have looked up her skirt with no good reason. Creepy dirty old men.
Vic,
There is supposed to be a closed hearing Monday regarding Teresa asking to have a new attorney ad litem, to get rid of Natalie “Superstar” Malonis.
Few have any doubt as to what walthers will do.
Whatever she does, I doubt it will be what Teresa wants or hopes for.
Even if walthers canned Malonis, she has a few more pro-CPS ad litems to select from.
There are a couple of them that filed to take away all the cell phones would be good candidates to replace Malonis!
It’s a no-win situation in Judge ‘make the rules as I go along” walthers courtroom.
I don’t think there will be a hearing Monday
Well, if you mean a true adversary hearing in the true due-process fashion, you’ll undoubtedly be right.
Otis,
Your words show only you and your witch-huntin buddies’ incredible bigotry toward the FLDS people local to you.
Only bigots can call “Environmental fines” proof of a baby killing farm. The laws that your wonderful state that they are a huntin little girls with, was WRITTEN for the Purpose of legalizing your state sanctioned witch hunt. And when a man steps forward to defend his church, the hunters call him “thug” for trying to stop them.
“Never forget that everything Hitler did in Germany was legal”
– Martin Luther King Jr.
It is you who is the bigot, it is you that does not know what it means to fly the flag the represents our Constitution, it is you who is only a mouth, and has no ears.
“And he said, Go, and tell this people, Hear you indeed, but understand not; and see indeed, but perceive not. ” Isaiah 6:9
Ol blue,
If you believe Shirtless over Willie, you will be wrong every time.
Hugh,
“We’ll see.”
Wasn’t it you that didn’t want too? Goodness man.
“We can observe a lot by watching” –Yogi Berra
17 Kurt Schulzke Well, if you mean a true adversary hearing in the true due-process fashion, you’ll undoubtedly be right.
No, I mean I don’t believe there will be any kind of hearing on Monday
I have a question. Does anyone here believe Warren Jeffs is not totally insane? Tells his 15 year daughter during the day she’s getting married that evening. At least it saves some money, no point in mailing out wedding invitations or being listed on some bridal registry.
Vic, your last comment reveals how you and the rest of the world is judging these people based on YOUR’S and the World’s concepts of ‘right’ ‘wrong’ and ‘tradition.’
These people are non-traditional in many ways - They live quietly, peacefully, with a desire to raise their children without aid of TV, raunchy music, near porn lyrics/movies, video games, etc.
And they choose to marry within their own belief system and according to their understanding of their holy books and their prophet.
As has been pointed out - numerous times - polygamy was common among the patriarchs and others in the Old Testament and no one raises a brow of condemnation or contempt. I don’t understand why it is even an issue in todays politicially correct sexual climate.
From what I understand - Raymond Jessop (Teresa’s alleged husband) has not been seen by anyone for well over a year. I believe he also has another wife who has stated that she has not seen him for a year and does not know where he is.
Does anyone even know if the man is alive?
Teresa will never get a fair hearing in Texas. There is not an unbiased bone to be found there, especially in the Eldorado/San Angelo community.
To be unbiased would mean that the judge and the jury would have to understand the FLDS doctrine and culture, and they would have to be untainted from the likes of Carolyn & Flora Jessop, Elissa Wall, Dan Fischer, etc. If any of the juror have read ANY of those inflammatory books/articles, they would have to be dismissed from any jury convened as having prejudice.
But, so far, Texas hasn’t been concerned about right/wrong, rights, or justice…
So I expect the kangeroo court and trial to continue.
At least Walthers is waiting until AFTER the July 22 Grand Jury to interrogate Teresa…guess she’s waiting to see if Teresa is a criminal or not before giving her any consideration.
If Teresa is indicted (for God knows what crime! Being 15 and engaged with your parents permission????) then, does she finally get rid of Malonis?
Now THAT would be a blessing!
I believe Ray was stopped for a trafffic violation near the ranch last week or so.
Thank you…but is that your belief or a fact? And, how do you know?
One can never be quite sure about anything these days. As you stated “does anyone even know he’s alive”
I kinda think he is. Hey did I happen to mention last night I was at this watering hole. Ask this gal how old she was. She said 38. I said how about we get sealed tonight. She said the only thing going to get sealed tonight is my mouth if I ask her again lol
Vic, I hope you see her a lot!
Seriously, you sound exactly like the mobocrats from Missouri in the 1830’s; jealous of those with faith.
